If you receive a traffic ticket in Galveston County, your case will be under the jurisdiction of either a Municipal or a Justice of the Peace (JP) Court. In order to properly fight your traffic ticket, the legal team at Tad Nelson and Associates, upon retention, will work with the prosecuting authority in order to get you deferred adjudication or a complete dismissal. If this avenue is not possible, an appeal bond will be filed with the JP or Municipal court and your case will automatically move up to a County Court. After the appeal is filed it may take up to four months for the County Court to schedule a court date for your case. However, once your case is finally put on the docket in the County Court we will pursue a FINAL result of your driving record remaining clean.
Mr. Nelson and his legal team will then appear in County Court on your behalf, and the result will be that you will receive either Deferred Adjudication or your case will be dismissed.
If you receive deferred adjudication your punishment will not result in a negative change in your driving record. This sentence is typically an instant deferred with no restrictive period and no conditions what so ever. Although most municipal and justice courts require attendance and successful completion of defensive driving courses, we are usually able to avoid any of these additional nuisance at the County Court level. With either dismissal or a deferred sentence, you will not have the ticket reflected on your driving record.
This is very important if you have received a traffic ticket in the past 12 months. The State of Texas stipulates that, if an individual receives three traffic tickets within a 12-month period anywhere in the state, they are subject to an Administrative License Revocation . This ALR hearing is similar in nature to the ALR hearing in a DWI case, in that you will need to appear before a judge to defend your right to drive. If you have prior tickets on your record, the suspension could last for a period up to two years in length. If you are a minor, the State of Texas has the option to suspend your license until you are 21 years of age.
