The Texas Juvenile Justice Code (§51.02) defines a child (juvenile) as a person who is:

• Ten years of age or older and under 17 years of age; or
• Seventeen years of age or older and under 18 years of age who is alleged or found to have engaged in delinquent conduct or conduct indicating a need for supervision as a result of acts committed before becoming 17 years of age.

All cases involving a juvenile criminal action are handled in Juvenile District or County Courts throughout the state. These cases are handled as "civil" rather than "criminal" in nature, although many aspects of criminal law apply. Instead of being found "guilty", juveniles are "adjudicated to have engaged in delinquent conduct." Juvenile offenders are not released from jail on bond or bail; instead they are released depending on the circumstances of their case. Punishment for a delinquent juvenile is set based on established levels and guidelines (referred to as sanction level guidelines), and not the offense.
