In Houston, DWI or Driving While Intoxicated is
classified as a criminal offense. The Texas Legislature
defines a DWI as “not having the normal use
of mental or physical faculties by reason of the
introduction of alcohol, a controlled substance,
a drug, a dangerous drug, a combination of two or
more of those substances, or any other substance
into the body” or “having
an alcohol concentration of 0.08 or more”.
(Texas Penal code 49.01). The Houston
prosecution only needs to prove one of the above
statements for a guilty DWI verdict.
In Houston, law enforcement uses either a breath, blood or urine test to determine someone’s BAC. The accuracy of these tests leaves much to be desired. Problems associated with the breath test include improper use, improper calibration, improper instructions to the user and the fact that the sample is not saved for testing by an independent lab. - Completed the training course as an Evidentiary Breath Alcohol Technician on the Intoxilyzer 5000 (current generation of breath machine in Texas).
- Completed the training course as an Evidentiary Breath Alcohol Technician on the Intoxilyzer 8000 (next generation machine, already in operation in several states).
